Fireworks ban takes effect in Lantana PDF Print E-mail

In response to several grass fires sparked by fireworks that threatened homes on New Year's Eve, the Lantana Community Association has officially banned the use of fireworks in the community.

The homeowner’s association board recently approved a new amendment to the covenants that prohibits all fireworks in Lantana and sent notification letters to the community’s 2,497 homeowners on Feb. 28.

“We are going to do everything we can do from an HOA standpoint to keep our residents safe,” said Mark Wagner, a LCA board member and president of Republic Property Group, Lantana's developer.

The amendment states that anyone caught discharging fireworks in Lantana may be hit with a fine and lose their privileges to access the community's amenity centers, swimming pools and exercise facilities.

Fireworks covered under the ban include sparklers, aerial fireworks, artillery shells, bottle rockets, brocades, firecrackers, fountains, roman candles, girandoles, repeaters, pinwheels, rockets of any kind, MD-80s and cherry bombs.  Read the amendment here.

Wagner said enforcement of the new rule will be handled by an education campaign with letters to residents, signage in the neighborhood and off-duty sheriff’s deputies patrolling the community on July 4th and New Year’s Eve that will report offenders to the HOA.

Previously, fireworks were allowed in Lantana on private property since the community sits in unincorporated Denton County.

“I applaud the HOA for jumping in and taking on this issue, and I hope the new rule deters irresponsible and dangerous behavior,” said Bill Featherstone, Lantana Crime Watch Coordinator.

“The big picture that our lawmakers in Austin need to see is that the public safety of residents living in fresh water supply districts has to be addressed, and the prohibition of fireworks is a piece of that puzzle."

Lantana's two fresh water supply district boards are expected to approve a resolution at their monthly meetings this week supporting the new rule and agree to work closely with the HOA and other FWSD's across Texas to lobby state legislators to ban fireworks in densely populated unincorporated areas.

While I can understand your view, I don't think you make a full ban without some sort of majority vote. Taking away everyone's right because a couple idiots isn't quite fair. And it wasn't myself or Aubrey that started the fire nor did your house burn down. Nor does anyone think they have a right to burn anyone's house down. So please stop with the sensationalist remarks. You should punish offenders that are being irresponsible, but not take away the rights of those who are. People speed in Lantana too, but what happens? Those who speed get tickets, but you don't ban the use of cars in Lantana do you? There's always a safety issue with anything in life, but pretty soon we are going to live in a bubble and each little thing like this is a sad step in that direction.

I am extremely disappointed that Lantana's governing boards are so quick to take our individual liberties. I, personally, do not support this change. I wonder how many people this actually represents, as I do not feel I have had an adequate opportunity to voice my concerns before this rule was voted into place, and my freedom to celebrate our nation's independence with my family using sparklers and other small fireworks has been taken away. Is Lantana going to put on a firework show? Otherwise, we must now fight crowds to celebrate. While I regret that damage has been done, a few minor incidents should not prompt rules and regulations and cause residents to give up our liberties and freedom. I would much prefer an education campaign on prudent practices and not lose our freedom to celebrate. I definitely do not support begging Austin for more rules and limitations! I am greatly saddened that our HOA and water boards would so quickly add such amendments that take away our liberty.

@Aubry: All other cities around Lantana don't allow fireworks due to safety. Let me know how you would feel when you see a wall of fire coming at your house at night from the golf course thanks to an irresponsible neighbor! I don't believe in giving you freedom to burn my house down!

I'm disappointed to see that the water supply district boards and the HOA are taking these stances without hearing from a broad spectrum of residents. I, personally, believe in personal freedoms and don't support additional legislative restrictions on these issues. I believe my personal freedom to celebrate our nation's independence with my family using sparklers is being infringed upon. I would much prefer a campaign reminding residents of prudent safety measures and enforcing current limitations while maintaining individual freedom. I am sad to see our freedoms given away so easily, and I definitely don't support lobbying Austin for more rules!
