Fireworks in Lantana

Postby Common Sense Al » Fri Jan 13, 2012 12:14 am

I wanted to start this topic to bring together recent info on Fireworks in Lantana. I'll try to keep this topic updated with links to any new & pertinent info.

On Dec 31, 2011, there was a fire at Meadows & Bonham on the golf course (see photos below). There were other grass fires reported as well, including across the street from Northstar Academy in Lantana.

Reports are that the Lantana HOA is currently implementing fireworks restrictions and will be notifying residents. There are also efforts underway to change state law to address the issue of fireworks in densely populated areas which are unincorporated.

Fireworks ban takes effect in Lantana

Here is the wording of the new amendment covering the prohibition of fireworks in Lantana:

Section 9.16. Fireworks. It is specifically prohibited, without exception whatsoever, to use, discharge, fire or shoot fireworks of any kind within the Lantana Property. This prohibition shall apply to all Lots, the Development Tract, the Golf Course and the Common Properties. For purposes of this Section, the term “fireworks” shall mean and refer to any explosive pyrotechnic display or device consisting of a combination of explosives and combustibles, set off to generate colored lights, smoke, and/or noise and shall, for purposes of illustration only but not limitation, include sparklers, aerial fireworks, artillery shells, bottle rockets, brocades, firecrackers, fountains, roman candles, girandoles, repeaters, pinwheels, rockets of any kind, MD-80s and cherry bombs. The violation of this Section may result in the imposition of fines and the suspension of the right to use and enjoy the Common Properties including the amenity centers, swimming pools and exercise facilities.

I read the letter, seems as if it has no "teeth" no real enforcement, imho, the violators most likely will not be fazed.

Would you rather no ban at all?

It's too bad they banned sparklers and the little stuff that you can keep on your own property, but I understand. We all 'pay' for the irresponsible acts of a few.

oh no please don't get me wrong I am very glad they are addressing it and very grateful for the ban. Just think I will still be hearing fireworks next year.
I wish it were a law, an enforceable law. I also wish we had a dedicated policeofficer.

With a couple of Sheriff's Deputies patrolling those two nights, I don't think many people who are aware of the ban will break the rules.

But can the County enforce an HOA regulation, or is it a Water District regulation (or a hail Mary ) ?

That asked, I think most people would respect it, or at least begin to to retrain themselves. Even with no real teeth, having even one person confront them about it is enough attention to make most people avoid it.

If the HOA hires the DSCO to patrol and report HOA violations, then the HOA can take action. The DSCO can also enforce county laws like littering or trespassing. The FWSD cannot enact ordinances.

About an hour and a half show in our neighborhood. Nice for those of us having to get up for work. Just call me grinch.

I definitely heard fireworks around, but couldn't tell for sure if they were coming from Lantana, so it was much more "peaceful" here than last year. No huge fireworks being launched over HOA property. I also saw a Sheriff's car drive down the street. Nice improvement, though I wish we didn't lose the privilege of using small fireworks responsibly on our own property (for the kids mainly).
