What beautifully stupid logic on behalf of the drilling company and the lease holders. "If we aren't allowed to steal property from the non-leasers, then they are stealing our money." It's equivalent to saying, "I should be able to bulldoze your beachfront home because it's keeping me from having a beachfront home."

If you're in the middle of the neighborhood and there are houses between you and the site, then too bad. Buy a house closer to the open space next time.

That's a true analogy, only if work was being done on the surface, but I don't think I've heard of any surface production breakthroughs yet. O&G has to go deep. Sometimes I think it would make sense to give the haters simple set backs. If the set backs are 500', they're 500' in all directions. Once they get beyond 500' deep, it's fair game. :D

Before it starts, ya, I know, Rule 37 is a complex issue and my solution doens't really have anything to do with it, it just makes it sound funny. :lol:

It is the State of Texas and the Railroad Commission's job, to conserve and "prevent waste" of natural resources. The Rule 37 exception will allow drilling beside the hold outs, not under them, ergo, preventing waste. Is it theft? Maybe on one hand but, not the other. If Titan is denied the Rule 37 exception, they could elect to complete (frac) 330 feet from each holdout. No other operator will come in to lease the holdouts, for a different well, making their 1/4 acre mineral right value worthless, anyway. Chesapeake is changing tactics, and has a case coming up soon, where they are not applying for Rule 37 exceptions , but forcing, thru legal channels, the Mineral Interest Pooling Act.

The MIPA was created to allow mineral owners, who have been Rule 37nd, to get back into a unit after realizing their mistake. I think Chesapeake's lawyers are trying to pervert the MIPA, into forced pooling, Which Texas doesn't have, but needs, to make 1/4 acre holdouts irrelevant.

Now we know who we can blame for recent fish kills in the FM ponds. All that there drilling on Mr. Hilliard's property. Those writs landed in the water and they're poisonous.

I drive by and don't notice the drill site is there. As usual. Who cares? Ain't hurtin' any body but Al F. and Missy Mellisa.

It won't be a problem until the energy company monkeys bang on the wrong pipe and blow the neighborhood sky high. The banana peels all over the road are quite a nuisance in the meantime.
